BY ACCESSING OR ATTEMPTING TO ACCESS ANY MYANATOMY PLATFORM SERVICES, AND/OR BY ACCEPTING THIS PRIVACY NOTICE, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ AND UNDERSTAND THE TERMS OF THIS PRIVACY NOTICE AND HAVE AGREED TO BE BOUND BY ITS TERMS. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY NOTICE, YOU MAY NOT USE, OR ATTEMPT TO USE, ANY MYANATOMY PLATFORM SERVICES.

WHO WE ARE:

MyAnatomy Integration Private Limited (Referred as "MyAnatomy"), a company having its registered office at, 2nd Floor, SYNo-5/3, Varthur Main Rd,BEML Layout, Whitefield, Bangalore,Karnataka - 560066 ("MyAnatomy", "we", "our" or "us") take the security of your personal data very seriously and are committed to protecting and respecting the privacy of the users (“you” or your”) of our MyAnatomy platform (Referred as the "Platform") also known as  "MATCH", "MAPIT", "MyAnatomy Assessment Platform".

WHAT IS THIS PRIVACY NOTICE FOR? 

We at MyAnatomy may handle your personal data or Personally identifiable information (PII) in connection with your use of the Platform . This privacy notice sets out, for the Platform, our collection and sharing practices, the uses to which personal data is put, the ways in which we protect it in accordance with the data protection laws and your privacy rights. Please read it carefully. This privacy notice covers the processing of your personal data on the Platform including the processing we do for our own purposes as well as the processing we do on behalf of our clients (who may be your current or potential employer or institute). If you are utilising the platform at the direction of one of our clients, certain sections of this notice may not apply to you. Personal data collected from users who are minors is dealt with in accordance with applicable law.

1. USE OF SERVICES
• You may only use the MyAnatomy PLATFORM Services to access an Account you are authorized to access and to conduct such transactions as you are authorized to conduct.
• You will not use the MyAnatomy PLATFORM Services for any illegal or improper purpose or take any action that could undermine the security or integrity of, or interrupt the operations of, the MyAnatomy PLATFORM Services. You agree not to modify, move, add to, delete or otherwise tamper with any proprietary information contained in the MyAnatomy Platform. You also agree not to decompile, reverse engineer, disassemble or unlawfully use or reproduce any of the software, copyrighted or trademarked material, trade secrets, or other proprietary information contained in the Platform.
• You agree to comply with all applicable local, provincial, state, national, international and foreign laws, treaties and regulations applicable to you in connection with the use of the MyAnatomy PLATFORM Services.


2. SHARING OF DATA BETWEEN USERS AND MYANATOMY
   The MyAnatomy Product is a platform which connects the users such as Colleges, Students and Corporates for their mutual benefit. The student data shared by the Colleges will be used by the Corporates, Training Institutes for further development of candidates, for assessing candidates for available job opportunities with the Companies and for similar purposes. Hence by sharing the student data on the platform the College acknowledges that they are fully aware of the purpose for which it is shared and will not hold MyAnatomy. responsible for any inadvertent data privacy infringements beyond the control of MyAnatomy.


3. PROTECTION OF INFORMATION
   MyAnatomy. is committed to protecting your information. Your information will be collected and used by MyAnatomy. and may be shared by MyAnatomy and MyAnatomy platform Users, to serve lawful purposes such as Training and Development of students, for securing job opportunities for students and for processing of data by third party when required for related events and campaigns. The use and transfer of your information will be strictly in accordance with the applicable data privacy law. By providing the information asked herein you acknowledge and agree that you fully understand your rights to access, correct, make any inquiries in relation to the use of personal information and withdraw your information anytime.


4. WARRANTY OF AUTHORITY
   If you are accessing the MyAnatomy PLATFORM Services on behalf of one or more business entities (such as a corporation or a partnership), you warrant that you have the full authority of each such business entity to do so. You further warrant that you have the authority to legally bind such business entities to the provisions of this Agreement.


5. COMMON VIEW
   If you have been given Common View rights, you agree to protect the confidentiality of the personal and/or business information of all of the business entities or individuals whose Accounts you are able to access pursuant to your Common View rights.


6. USER IDS AND PASSWORDS
• Password Confidentiality: You agree to keep your User ID and Password absolutely confidential and to ensure your Password is never disclosed, accidentally or otherwise, to anyone at any time. You are solely responsible for the maintenance and security of your User ID and Password.
• Use of User ID and Password: You are responsible for all consequences and losses relating to the use of your User ID and Password, whether or not you authorized that use. If you know or suspect your User ID or Password is being misused, you must as soon as possible, notify MyAnatomy. by telephone or e-Mail
• and, immediately change your Password (please see the instructions on the platform on how to change password). You agree that, until we receive such notice and have had a reasonable opportunity to implement measures to prevent unauthorized use of your User ID or Password, you will remain liable for all unauthorized use of your User ID or Password that may occur as a result of authorized or unauthorized use of your User ID and Password. Once we have received proper notice from you and we have had a reasonable opportunity to implement measures to prevent unauthorized use of your User ID and Password, you will no longer be responsible for unauthorized use of your User ID or Password from that point forward. You understand and acknowledge that MyAnatomy. shall incur no liability whatsoever for any consequences and/or losses that occur through your use or misuse of your User ID and Password.


7. ELECTRONIC INSTRUCTIONS
   MyAnatomy. may treat your Electronic Instructions as documents written and signed by you. You acknowledge that an Electronic Instruction is final, and you cannot object to it later. MyAnatomy. may, at its sole discretion, decline to act on Electronic Instructions and shall not incur any liability for failing to do so. MyAnatomy. may maintain a database of your Electronic Instructions.


8. RECORDS
   MyAnatomy. 's records of your Electronic Instructions will be conclusive and binding on you in any disputes, including any legal proceedings, as the best evidence of your Electronic Instructions in absence of clear proof that MyAnatomy's records are wrong or incomplete.


9. SECURITY
   MyAnatomy. is committed to keeping your confidential information safe and has in place reasonable measures to protect the security of the MyAnatomy PLATFORM Services. In order to protect you and your data, MyAnatomy. may suspend your Account, without notice, pending an investigation, if MyAnatomy. suspects that a breach of security has occurred. You acknowledge that ensuring the security of your information (including personal, financial and business information) requires you to exercise safe computing practices. These safe computing practices are in addition to your responsibility to maintain the confidentiality of your User ID and Password. You must properly log off, disconnect and close your Internet browser after each session in which the MyAnatomy PLATFORM Services have been accessed or used.


10. ACCESS DEVICE USAGE
• The Access Device you use to access the MyAnatomy PLATFORM Services may be vulnerable to viruses or online attacks that seek to intercept sensitive information that you provide through the Internet. To reduce the chances of harm, it is your responsibility to ensure that any Access Device you use to access the MyAnatomy PLATFORM Services has an up-to-date anti-virus program, anti-spyware program and firewall.
• MyAnatomy. does not assume any liability or responsibility whatsoever for computer viruses or other destructive programs received during the electronic transmission of content from the MyAnatomy PLATFORM Services or any sites accessed through links provided through the MyAnatomy PLATFORM Services.


11. PRIVACY
    By accessing and using the MyAnatomy PLATFORM Services, you acknowledge and accept My Anatomy’s Privacy Policy, as amended from time to time.

Data Candidates or Users provide

MAPIT Test requires below accesses to provide usability

• Internet Connectivity: The MAPIT platform requires internet access in order to communicate with the servers.
• Device Camera: The platform requires to access candidate’s device camera, as some tests require monitoring of candidates while they attempt the test to avoid malpractices/suspicious activities and to allow candidates to submit their photo for verification purposes.
• Device Storage: The platform requires to access the device storage so that it can store and collect all the test relevant files.
• Screen Sharing and Recording: The platform requires to access candidate’s or user’s test screen Or windows as some tests and video interviews require monitoring of candidate while they attempt the test to avoid malpractices/suspicious activities and Candidates need to share their test screen / windows which gets recorded for verification purposes.
• Device Mic/Audio Recording: The platform requires access to device mic to record candidate speech while candidate attempts audio-based test.

Data MyAnatomy collect:

MAPIT Test receives or collects information when we operate and provide our services, including when you install, access or use our Services.

• MyAnatomy collect candidate’s device information so that we can uniquely identify your device.
• Information that you enter in application will be collected and stored

12. USE OF CONTENT AND COPYRIGHT CONCERNS WITH PLATFORM Any content from the platform namely tests questions and pattern copied and presented on any social / Electronic or physical media will be subjected to copyright violation and infringement. MyAnatomy holds the copyright ownership and “All rights reserved” under copyright law.


13. CONTENT
    MyAnatomy. offers the MyAnatomy PLATFORM Services in order to improve the accessibility of information to its customers. The MyAnatomy PLATFORM Services are not intended to provide management, financial, technical or other advice and they are not intended to be used as a substitute for specific professional advice. You assume all responsibility for your use or non-use of the information you obtain through the MyAnatomy PLATFORM Services and you assume all responsibility for any action or inaction you may perform or refrain from performing based on the information you obtain through the MyAnatomy PLATFORM Services.


14. INTELLECTUAL PROPERTY
    The content of the MyAnatomy PLATFORM Services may be protected by copyright. You may not copy, reproduce, publish, distribute, modify or perform any content protected by copyright without obtaining permission of the copyright owner. You are granted a limited license to view the content contained in the MyAnatomy PLATFORM Services via an electronic display for your personal (including your business) purposes only. Any other use or distribution of the content, in whole or in part, is prohibited without the written consent of the author. MyAnatomy. and its Information Providers and licensors reserve all intellectual property rights to content included within the MyAnatomy PLATFORM Services


15. LIMITATIONS OF LIABILITY

1. In addition to any other limitations on MyAnatomy. 's liability contained elsewhere in this Agreement, MyAnatomy. 's liability for loss or damages arising under this Agreement or in connection with the MyAnatomy PLATFORM Services will be limited in the aggregate to direct damages arising out of the failure of MyAnatomy. 's employees to take commercially reasonable steps to comply with MyAnatomy. 's obligations under this Agreement.
2. Under no circumstances shall MyAnatomy. (or its directors, officers, employees, agents, representatives, affiliates and Information Providers) be liable to you or any Third Party:
• for any direct or indirect, special or consequential damages, or for any loss of profit, loss of revenue, loss of reputation or loss of business opportunity, that result in any way from your access or use of the MyAnatomy PLATFORM Services or from your use or non-use of the information you obtain through the MyAnatomy PLATFORM Services, or from any action or inaction you may perform or refrain from performing based on the information you obtain through the content of the MyAnatomy PLATFORM Services
• for any losses, damages or expenses arising out of your use or non-use of, or reliance or non-reliance on, any MyAnatomy PLATFORM Services or access to the Internet or any part thereof;
• for any losses, damages or expenses (including legal fees) arising out of any allegation, claim, suit or other proceeding based on a contention that the use of the MyAnatomy PLATFORM Services by you or a Third Party infringes the intellectual property rights or contractual rights of any Third Party; and
• for any losses, damages or expenses arising due to events beyond MyAnatomy. 's control.
3. The limitations and exclusions of liability described in this Agreement shall apply regardless of whether the cause of action is in contract (including, without limitation, breach of a fundamental term) or tort (including, without limitation, negligence).
4. The limitations and exclusions of liability contained in this Agreement shall apply to the farthest extent allowed by law.

16. WARRANTY DISCLAIMER
    To the fullest extent permitted by law, MyAnatomy. provides the MyAnatomy PLATFORM Services on an "as is, where is" basis and does not make any express or implied warranties, representations, endorsements or conditions with respect to the MyAnatomy PLATFORM Services or to any content or information contained in or provided by the MyAnatomy PLATFORM Services. You have sole responsibility for adequate protection and backup of data and/or Access Devices and to take reasonable and appropriate precautions to scan for computer viruses or other destructive properties.
• This includes, without limitation, warranties as to merchantability, operation, non-infringement, usefulness, completeness, accuracy, correctness, reliability or fitness for a particular purpose. Further, to the fullest extent permitted by law, MyAnatomy. does not represent or warrant: that the MyAnatomy PLATFORM Services will be available and meet your requirements; that access to the MyAnatomy PLATFORM Services will be uninterrupted; that there will be no delays, failures, errors or omissions with the MyAnatomy PLATFORM Services that there will be no loss of transmitted information from or through the MyAnatomy PLATFORM Services;
• that no viruses or other contaminating or destructive properties will be transmitted by or through the use of the MyAnatomy PLATFORM Services; or that no damage will occur to your computer system by or through the use of the MyAnatomy PLATFORM Services.

The display of trademarks on pages of the MyAnatomy PLATFORM Services does not imply that a license of any kind has been granted to you. You may not use the trademarks, logos and service marks (“Marks”) for any purpose including, but not limited to, use as hyperlinks, hot links, or meta tags in other pages or Internet sites without the written permission of the owner of the Marks, whether that is MyAnatomy. or one of its Information Providers.


19. EXTERNAL LINKS
    Links to websites provided as part of the MyAnatomy PLATFORM Services are meant for convenience only. MyAnatomy. is not responsible for the content, accuracy or opinions expressed in such websites and MyAnatomy. does not investigate monitor or check the accuracy or completeness of Third Party websites. Inclusion of any linked website does not imply approval or endorsement by MyAnatomy. of the linked websites or contents or information contained in such websites. MyAnatomy. does not assume any liability or responsibility whatsoever for the operation of, or content at, any of the linked resources, nor for any of the interpretations, comments or opinions expressed therein.


20. GOVERNING LAW, ARBITRATION AND SUBMISSION TO JURISDICTION.
    This Agreement shall be governed by, and construed and enforced in accordance with, the laws of the land, without giving effect to the principles of conflicts of law thereof. Subject to any court of competent jurisdiction in Bangalore, Karnataka State, India shall have jurisdiction and venue in any proceeding instituted to enforce this Agreement and any objections to such jurisdiction and venue are hereby waived.


21. INTERNATIONAL DATA TRANSFERS

MyAnatomy platform is primarily operated and managed on servers located and operated within India. However, owing to the global nature of MyAnatomy, your Personal Data may also be stored in third party data servers located in other countries where MyAnatomy provides its products and services.

MyAnatomy engages sub-contractors, service providers and other third parties for facilitating our products, service offerings and to offer support services to you, and your Personal Data may be transferred to servers of such sub-contractors, service providers and other third parties. Depending upon the location of our service providers, your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

Further, your Personal Data may be transferred may be shared, disclosed, and transferred between various MyAnatomy group companies where such transfers are required for legitimate business reasons.

Where required under applicable law we will seek your express consent for such transfers. In all other cases, by consenting to this policy, you also provide consent to MyAnatomy to transfer your Personal Data to MyAnatomy affiliated companies, service providers or any third-party entity in locations around the world. We take steps to ensure that a degree of data protection which is similar to this policy is afforded to such Personal Data transferred.

Where MyAnatomy transfers your personal information internationally, we will comply with applicable legal requirements and where required we will enter into a data transfer agreement with the recipient of the personal information, which in the case of European Personal Data may include the Standard Contractual Clauses. In other cases, and where applicable, we shall enter into separate Data Processing Agreements with the third parties / service providers / contractors and such other recipients of Personal Data. Further as the Company takes steps to ensure that transfers of Personal Data to any public authority cannot be massive, disproportionate, and indiscriminate in a manner that would go beyond what is necessary in a democratic society. In the event of conflicts between these and public authority requirements, the company will find a practical solution that fulfils the purpose of this Policy. We are committed to take all steps reasonably necessary to ensure that your data is treated securely and in accordance with our data privacy and security standards.

    MyAnatomy. may change the terms and conditions of this PRIVACY NOTICE from time to time in any one or more of the following ways: a notice displayed on the MyAnatomy. Web Site and/or on the login screens accessed when using the MyAnatomy PLATFORM Services; and/or by requiring you to electronically accept the additional or amended terms and conditions of this PRIVACY NOTICE at any time. If you continue to use any of the MyAnatomy PLATFORM Services after the effective date of any additional or amended terms or conditions to this PRIVACY NOTICE, then you will be deemed to have accepted such additional terms or conditions.


23. TERMINATION
    MyAnatomy. reserves the right, in its sole discretion, to suspend or terminate any MyAnatomy PLATFORM Services or your use of any MyAnatomy PLATFORM Services at any time and for any reason.


24. SEVERABILITY
    Any provision of this PRIVACY NOTICE which is, deemed to be, or becomes void, illegal, invalid or unenforceable shall be severable from this PRIVACY NOTICE and shall not impair the remaining provisions of this PRIVACY NOTICE.


25. LANGUAGE
    The parties or concerned users to this PRIVACY NOTICE have required that this PRIVACY NOTICE and all deeds, documents and notices related to this PRIVACY NOTICE be drawn up in the English language.
